Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Baller mobile application (the "App") operated by Yaozhuo Sun ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

• You must create an account to use the App's features.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.
• Notify us immediately if you suspect unauthorized access to your account.

3. Subscription and Payments

3.1 Subscription Plans

The App may offer subscription-based access to premium features. Subscription details, including pricing and billing frequency, are displayed in the App and on the Apple App Store.

3.2 Billing

• Subscriptions are billed through Apple's App Store. All payments are processed by Apple and are subject to Apple's terms and conditions.
• Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date.

3.3 Cancellation and Refunds

• You can cancel your subscription at any time through your Apple ID settings.
• Cancellation takes effect at the end of the current billing period; you will retain access until then.
• Refund requests are handled by Apple in accordance with their refund policy.

3.4 Price Changes

We reserve the right to change subscription prices. We will notify you in advance of any price changes. Continued use after the price change constitutes acceptance.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

4.2 Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App to transmit harmful, offensive, or infringing content
• Interfere with or disrupt the App's functionality
• Use automated means (bots, scrapers) to access the App
• Resell, redistribute, or sublicense access to the App

4.3 User Content

Any content you submit through the App (such as training notes, feedback, or voice input) remains yours. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store that content solely for the purpose of providing and improving the App's services.

5. AI-Generated Content

5.1 Training Plans and Recommendations

The App uses artificial intelligence to generate personalized training plans, exercise recommendations, and coaching suggestions. This content is generated algorithmically based on the information you provide.

5.2 Not Medical or Professional Advice

AI-generated content is for informational and training purposes only. It does not constitute medical advice, professional athletic coaching, or physical therapy. You should:

• Consult a qualified healthcare provider before starting any new exercise program, especially if you have injuries or medical conditions
• Use your own judgment when following any training recommendations
• Stop any exercise that causes pain or discomfort

5.3 No Guarantee of Results

We do not guarantee any specific training outcomes, performance improvements, or results from using the App. Individual results vary based on many factors outside our control.

6. Health and Safety Disclaimer

• Physical activity involves inherent risks. By using the App, you acknowledge that basketball training and physical exercise carry risks of injury.
• You assume full responsibility for your own health and safety while performing any exercises or training activities suggested by the App.
• If you reported injuries during onboarding, the App will attempt to accommodate your constraints, but this is not a substitute for professional medical guidance.
• We are not liable for any injuries, health complications, or damages arising from your use of training content provided through the App.

7. Intellectual Property

• The App, including its design, code, content, logos, and trademarks, is owned by us and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
• "Baller" and associated branding are our trademarks.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Results obtained from the App will be accurate or reliable
• Any defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine is harmful to other users or our business.
• Upon termination, your license to use the App ceases immediately. Provisions that by their nature should survive termination (such as limitation of liability and indemnification) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. The "Last Updated" date at the top indicates when the Terms were last revised. Your continued use of the App after changes constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through friendly negotiation first. If negotiation fails, disputes shall be submitted to the competent court in the jurisdiction where we are located.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.
